Code Chapter UWS 18 (Conduct on University Lands)<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/21\">Wis. Admin. Code Chapter UWS 21 (Use of University Facilities)<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.wisconsin.edu\/uw-policies\/uw-system-administrative-policies\/youth-protection-and-compliance-2\/\">UW System Admin Policy 635 (Youth Protection and Compliance)<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"uwm-l-row uwm-l-row--4\">\n<div class=\"uwm-l-col uwm-l-col--3\">\n<h2 class=\"wp-block-heading\" id=\"h-purpose\">Purpose<\/h2>\n<\/div>\n\n\n\n<div class=\"uwm-l-col\">\n<p>University of Wisconsin-Milwaukee (51ÁÔÆæ) is part of vibrant neighborhood and city, and its facilities are often utilized by guests, whose presence enrich and strengthen our campus community through their involvement in 51ÁÔÆæ\u2019s programs and activities.&nbsp; However, all facility users, including guests, must comport themselves in a manner that ensures the safety and security of everyone who uses 51ÁÔÆæ\u2019s facilities. The purpose of this policy is to outline the behavioral expectations for guests in 51ÁÔÆæ\u2019s facilities and to formalize the process to limit and\/or prohibit their access to 51ÁÔÆæ facilities if necessary, so that 51ÁÔÆæ\u2019s facilities can continue to be welcoming, accessible, and safe.&nbsp;&nbsp;<\/p>\n\n\n\n<p>This policy, among other laws, regulations, and policies, including <a href=\"https:\/\/uwm.edu\/policy\/library\/faculty-staff-code-of-conduct\/\">51ÁÔÆæ\u2019s Code of Conduct (SAAP 07-03)<\/a>, prohibits behavior that substantially affects the ability of any person or group to learn, work, or live in the campus community. This includes subjecting another person or group to abusive, demeaning, harassing, humiliating, intimidating, or violent behavior, and verbal or written communication that threatens violence.&nbsp;<\/p>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"uwm-l-row uwm-l-row--4\">\n<div class=\"uwm-l-col uwm-l-col--3\">\n<h2 class=\"wp-block-heading\" id=\"h-definitions\">Definitions<\/h2>\n<\/div>\n\n\n\n<div class=\"uwm-l-col\">\n<p><strong>Building Chairperson<\/strong> &#8211; The 51ÁÔÆæ employee designated to oversee certain aspects of the management of a 51ÁÔÆæ building as set forth in <a href=\"https:\/\/uwm.edu\/policy\/library\/building-chairpersons\/\">51ÁÔÆæ\u2019s Building Chairperson Policy (SAAP 06-02)<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Guest<\/strong> &#8211; Any individual who is not currently a 51ÁÔÆæ student or a 51ÁÔÆæ employee but is present in a 51ÁÔÆæ Facility, including a sporadic visitor, a patron of a public event or 51ÁÔÆæ-sponsored program, a community member, or an invitee.&nbsp;<\/p>\n\n\n\n<p><strong>Facility<\/strong> &#8211; Any building owned by, leased by, or otherwise subject to the control of 51ÁÔÆæ.&nbsp;<\/p>\n\n\n\n<p><strong>Minor<\/strong> &#8211; A Guest under the age of 18.&nbsp;<\/p>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"has-alpha-channel-opacity\" \/>\n\n\n\n<div class=\"uwm-l-row uwm-l-row--4\">\n<div class=\"uwm-l-col uwm-l-col--3\">\n<h2 class=\"wp-block-heading\" id=\"h-policy\">Policy<\/h2>\n<\/div>\n\n\n\n<div class=\"uwm-l-col\">\n<h3 class=\"wp-block-heading\" id=\"h-i-guest-conduct-rules\">I. Guest Conduct Rules<\/h3>\n\n\n\n<p>By entering a 51ÁÔÆæ Facility, Guests agree to abide by and be bound by this policy.&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list uwm-c-list--upper-alpha\">\n<li><strong>Behavioral Expectations.<\/strong> Guests must:&nbsp;\n<ul class=\"wp-block-list\">\n<li>Obey all federal, state, and local laws, including\u202f<a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\">Wisconsin Administrative Code Chapter UWS 18<\/a>,\u202fwhich governs conduct on university lands.\u00a0 <a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\">Wisconsin Administrative Code Chapter UWS 18<\/a> includes rules such as:\u00a0\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\/07\">UWS 18.07 Use of Campus Facilities<\/a>, which, among other things prohibits climbing on buildings, entering unauthorized areas, camping, blocking or restricting entrances, or erecting unauthorized structures.\u00a0<\/li>\n\n\n\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\/08\">UWS 18.08 Personal Conduct Prohibitions<\/a>, which, among other things, addresses the appropriate storage of bicycles, following posted signage, and the misuse of university ID cards, university keys, and parking spaces.\u00a0<\/li>\n\n\n\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\/09\">UWS 18.09 Alcohol and Drug Prohibitions<\/a>, which prohibits the use or possession of alcohol beverages on university premises (with certain limited exceptions), the use or possession of marijuana on university lands, or the use or possession of drug paraphernalia.\u00a0<\/li>\n\n\n\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\/10\">UWS 18.10 Offenses against Public Safety<\/a>, which, among other things, prohibits assaultive behavior, possession of fireworks, or resisting or obstructing police officers.\u00a0<\/li>\n\n\n\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\/11\">UWS 18.11 Offenses Against Public Peace and Order<\/a>, which, among other things, addresses misuse of computers or telephones, use of sound amplifying equipment on university land, and selling goods or services on university land.\u00a0 Also prohibits persons convicted of crimes involving danger to property or persons on university lands from entering university lands for 2 years after the conviction date.\u00a0<\/li>\n\n\n\n<li><a href=\"https:\/\/docs.legis.wisconsin.gov\/code\/admin_code\/uws\/18\/12\">UWS 18.12 Property Offenses<\/a>, which, among other things, addresses vandalism and theft.\u00a0<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Comply with applicable 51ÁÔÆæ policies, including policies relating to firearms and dangerous weapons, use and possession of alcohol, smoke and tobacco-free campus, and discriminatory conduct.&nbsp;<\/li>\n\n\n\n<li>Comply with all posted signs.&nbsp;<\/li>\n\n\n\n<li>Comply with all Facility rules including:&nbsp;\n<ul class=\"wp-block-list\">\n<li>Appropriate manner and location for consuming food and beverages and disposal of waste;&nbsp;<\/li>\n\n\n\n<li>Presenting valid identification as required by the Facility; or&nbsp;&nbsp;<\/li>\n\n\n\n<li>Leaving the Facility when the building closes to the public except as authorized in a Facilities Use Agreement with 51ÁÔÆæ or with prior written consent of a Building Chair or a Space Assignment Authority.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Comply with reasonable requests of 51ÁÔÆæ employees, including requests to leave the Facility.&nbsp;<\/li>\n\n\n\n<li>Use the Facility, and any 51ÁÔÆæ property in the Facility such as furniture or computers, for the purposes for which it was intended, designed, and is suited.&nbsp;&nbsp;<\/li>\n\n\n\n<li>Treat all 51ÁÔÆæ employees, students, and other Facility users with respect.&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Behavioral Prohibitions.<\/strong> In addition to the conduct rules above, Guests may not, among other behavior, engage in the following conduct:&nbsp;&nbsp;&nbsp;\n<ul class=\"wp-block-list\">\n<li>Exhibit any threatening or intimidating behaviors, e.g., abusive language, threats of violence, unwarranted physical contact, or intimidating gestures.&nbsp;<\/li>\n\n\n\n<li>Engage in behavior that is unsafe or harmful to their self or others.&nbsp;<\/li>\n\n\n\n<li>Obstruct or impair 51ÁÔÆæ activities in the Facility.&nbsp;<\/li>\n\n\n\n<li>Disrupt, interfere with, or impede the ability of other Facility users to participate in 51ÁÔÆæ activities or use the Facility.&nbsp;&nbsp;<\/li>\n\n\n\n<li>Leave any personal property unattended. Unattended property will be considered abandoned property and may be disposed of at 51ÁÔÆæ\u2019s sole discretion.&nbsp;<\/li>\n\n\n\n<li>Use Facility areas for prolonged sleeping (not including incidental napping) or as living quarters.&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-ii-minors\">II. Minors<\/h3>\n\n\n\n<p>51ÁÔÆæ welcomes minors as guests to its campuses because they are valued community members and are the university students of the future.&nbsp; At the same time, universities have increasingly grappled with the potential for minors to be exploited while in university facilities because such facilities are primarily designed for access by adults and often are largely unsupervised.&nbsp; Given its extensive open facilities in an urban setting, 51ÁÔÆæ is especially concerned about the potential for harm to guests who are unsupervised minors.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>In light of those concerns for safety, minors who are supervised by an adult are welcomed in public spaces throughout 51ÁÔÆæ, but <em>unsupervised<\/em> minors are generally restricted from using a 51ÁÔÆæ Facility except as described further below.&nbsp;<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list uwm-c-list--upper-alpha\">\n<li>Unsupervised minors may visit or use a 51ÁÔÆæ Facility if they are:&nbsp;\n<ul class=\"wp-block-list\">\n<li>Currently enrolled at 51ÁÔÆæ; or&nbsp;<\/li>\n\n\n\n<li>On their way to or from a Facility where they will be supervised by an adult; or&nbsp;<\/li>\n\n\n\n<li>On their way to or from, or attending, a 51ÁÔÆæ-sponsored program or activity as a registered participant; or&nbsp;<\/li>\n\n\n\n<li>On their way to or from, or attending, a 51ÁÔÆæ Facility or a 51ÁÔÆæ event open to the general public that expressly permits access by unsupervised minors.&nbsp;&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>A Building Chairperson may establish a policy permitting unsupervised minors as young as age 12 to use an individual Facility if appropriate based on the nature of the Facility\u2019s activities and services to the public.&nbsp; Similarly, an event host may establish a policy permitting unsupervised minors as young as age 12 to attend an event open to the general public if appropriate based on the nature of the event. Any such policy must state the specific minimum age allowed for unsupervised minors, not to be less than age 12.&nbsp;<\/li>\n\n\n\n<li>Wherever possible, enforcement of the provisions governing minors will be focused on educating minor guests and their parents\/guardians about the policy and its goal to ensure safety.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-iii-options-for-addressing-guest-conduct-enforcement\">III. Options for Addressing Guest Conduct \/ Enforcement<\/h3>\n\n\n\n<p>If a Guest does not comply with this policy, or engages in or attempts to engage in prohibited conduct, the following options exist to address the conduct:&nbsp;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-alpha\" class=\"wp-block-list\">\n<li>Any individual may report the Guest\u2019s conduct to the Building Chair, designee of the Building Chair, security personnel for the 51ÁÔÆæ Facility, or any other 51ÁÔÆæ employee with authority for responding to conduct issues in the 51ÁÔÆæ Facility or in a portion of the 51ÁÔÆæ Facility.&nbsp; Any of those individuals to whom a report may be made may require the Guest engaging in the prohibited conduct to show valid identification and\/or ask the Guest to promptly leave the 51ÁÔÆæ Facility or a portion of the 51ÁÔÆæ Facility. As stated above, wherever possible, enforcement of the provisions governing minors will be focused on educating minor guests and their parents\/guardians about the policy and its goal to ensure safety.&nbsp;<\/li>\n\n\n\n<li>Any individual may report prohibited conduct by a Guest to the 51ÁÔÆæ Police.&nbsp; It is noted that none of the enforcement options listed in this section are intended to supplant law enforcement\u2019s authority to subject individuals to arrest and criminal prosecution under provisions of applicable local or State law.&nbsp;&nbsp;&nbsp;<\/li>\n\n\n\n<li>A Guest may be banned for a specified time period (e.g., temporarily) or permanently from a 51ÁÔÆæ Facility or a 51ÁÔÆæ campus.&nbsp;&nbsp;&nbsp;\n<ul class=\"wp-block-list\">\n<li>An individual building ban may be issued in writing by either a Building Chair or a Space Assignment Authority as identified in <a href=\"https:\/\/uwm.edu\/policy\/library\/use-of-facilities\/\">51ÁÔÆæ SAAP 06-05 (Use of Facilities Policy)<\/a>.\u00a0 A template building ban letter may be requested from the Office of Legal Affairs.\u00a0<\/li>\n\n\n\n<li>A campus ban may be issued in writing by the Chancellor or Vice Chancellor for Finance &amp; Administrative Affairs as the Chancellor\u2019s designee.&nbsp; Individuals who are banned from a campus are identified on a 51ÁÔÆæ Police Department website, along with general information for the campus community about safety and how to address concerning behavior in 51ÁÔÆæ facilities.&nbsp;<\/li>\n\n\n\n<li>Any ban issued, whether building specific or campus wide, must be shared with the 51ÁÔÆæ Police Department.&nbsp;&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n<\/div>\n","protected":false},"author":1287,"parent":0,"menu_order":0,"template":"","meta":{"_acf_changed":false,"footnotes":"","uwm_wg_additional_authors":[]},"categories":[37,49],"topic":[25],"class_list":["post-739","library","type-library","status-publish","hentry","category-administrative-policies-procedures","category-selected-academic-and-administrative-policies","topic-facilities"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.3 (Yoast SEO v27.3) -
